CONSULTANCY SERVICES TO REVIEW AND UPDATE LEGAL FRAMEWORK FOR THE CULTURAL DEVELOPMENT PROGRAMME

(CONSULTING FIRM)

The Government of the Republic of Malawi through the Ministry of Industry, Trade and Tourism, has received financing from the African Development Fund (ADF) towards the cost of support to the Promoting Investment and Competitiveness in Tourism Sector (PICTS) Project. The Implementing Agency intends to apply part of the proceeds to finance payments under the contract for the consultancy to Review and Update Legal Framework for the Cultural Development Programme.

Objective of the Consultancy :

The objective of the assignment is to review, update and redraft the existing cultural development legal framework. The redrafted cultural development legal framework will incorporate cultural changes that have taken place within the sector in order for Malawi to catch up with emerging trends in cultural preservation, conservation, promotion and sustainable development

The services included under this project are:

  • Review existing cultural legal and regulatory framework, that is, Monuments and Relics Act of 1990, the Arts and Crafts Act of 1990, the Printed Publications Act of 1947, the National Archives Act of 1975 and the Museums Act of 1989;
  • Review the relevant cultural legislations in the SADC region ;
  • Review the relevant international conventions and protocols on culture, specifically those that Malawi has ratified;
  • Identify legal and regulatory issues that may hinder implementation of the Monuments and Relics Act of 1990, the Arts and Crafts Act of 1990, the Printed Publications Act of 1947, the Censorship and Control of Public Entertainment Act of 1968, the National Archives Act of 1975 and the Museums Act of 1989;
  • Provide recommendation on amendments to the Monuments and Relics Act of 1990, the Arts and crafts Act of 1990, the Printed Publications Act of 1947, the National Archives Act of 1975 and the Museums Act of 1989;
  • Facilitate national stakeholder consultations and validation workshop. After presenting the amendments to the task force, the consultant is expected to present the revised documents to national level stakeholders for validation;
  • Redraft the bills based on iii, iv and v; and
  • Present final drafts of the Monuments and Relics Act 1990, the Arts and crafts Act 1990, the Printed Publications Act 1947, the National Archives Act 1975 and the Museums Act 1989 to the Ministry responsible for Culture and other relevant stakeholders.

Required Qualification and Experience

  • The duly registered consulting firm must have the following personnel;
  • The Team Leader must be cultural expert with,
  • Atleast a Master’s Degree in relevant field. A PhD will be an added advantage,
  • At least 10 years relevant experience
  • Other trainings in the area of assignment will be an asset
  • An understanding of the cultural dynamics in the SADC region would be desirable
  • The team members should have a minimum of Bachelor’s Degree in their below areas of specialisation and at least five (5) years’ experience,

Legal Expert :

  1. Cultural Specialist
  2. Cultural Heritage Management Expert
  3. Cultural Heritage Development Expert

The Ministry of Industry, Trade and Tourism now invites eligible consultants to express their interest in providing these services. Interested consultants must provide information indicating that they are qualified to perform the services (brochures, description of similar assignments, experience in similar conditions, availability of appropriate skills among staff, etc.). Consultants may constitute joint-ventures to enhance their chances of qualification.

Eligibility criteria: establishment of the short-list and the selection procedure shall be in accordance with the African Development Bank’s “Rules and Procedures for the use of Consultants” (May 2008 Edition, Revised July 2012), which is available on the Bank’s website at http://www.afdb.org. The Ministry of Industry, Trade and Tourism is under no obligation to shortlist any consultant who expresses interest.

The estimated duration of services is 6 months and the estimated starting date is Monday, 29th April, 2019 or earlier than that.
